(Ed.)The following letter is in response to my inquiry to Joni Eastley about open meeting laws. Even though these laws prohibit any closed, secret meetings by any group that is supported by our taxes, the exception is as Joni says below.

Hi Charley: 

I’m gradually wading my way through my emails and this one of yours is next on my list.  I just sent a response to one you mailed earlier to this one. 

The board of county commissioners (and other elected and appointed boards throughout Nevada) routinely hold closed sessions, which we are permitted to do by law.  Those meetings are limited to discussions concerning labor negotiations, which are confidential, or consultations with our general counsel related to pending, current or potential litigation.  The closed legal sessions are also confidential, as they involve the exchange of information that is considered “attorney-client privileged”.  Discussions that you or others may have with your legal counsel are also considered privileged and you are not required to disclose the substance of those conversations.  The same is true of elected and appointed boards.  Since the discussions are of a sensitive nature, disclosure of which could either negatively affect the outcome of labor negotiations or litigation, we are not required by law to disclose their substance.  The BTAB is no different in this regard than the BoCC.  I’m not aware of when they held their meeting with their counsel, but I would not have been entitled to know about it or participate since I am not a member of that board.

As I said in my previous email, since I’m not a member of their board, I would not be entitled to participate in their closed sessions.  As a result, I’m not aware of when it was held.  It might be useless information anyway, since neither of us is entitled

to know what they discussed.   Sorry I couldn’t be of more help. I honor and support the press’ obligation to report the news, and respect the right to freedom of speech.  The hard part is balancing that right against the right of government to have some degree of confidentiality in certain proceedings, just as is done in the private sector or in our private lives.  Another way to think of this is that if they were discussing Janet Rogers, which I assume is what you suspect, she also has a right to privacy when it comes to issues of personnel.

ATTENTION, ALL COOP MEMBERS,

You know, we own this Company, Valley Electric, but we have no say in how it's run.  I take that back...we can object but it does no good!  We'll see about that!  It is obvious that VEA doesn't want us to know how OUR OWN business is being managed.  They want to keep us in the dark so that we can't fight while we watch them WASTE OUR INVESTMENTS.  Not too long ago we would receive monies each year.  Our C0-OP was doing well....what happened?  Are we ALL to take on the expense that VEA needs to support the PRISON?  Why aren't THEY taking on the excessive costs to make it work?  Why us?  Were we asked?  Oh, right....we USED to have AMBASSADORS (from the Latin word ambactus, meaning SERVANT)...6 or 8 or 80 or so..who knows, but now we have a $78,000 a year LOBBYIST instead.  I guess the Ambassadors got all upset because they never got ONE THIN DIME!!...wrong again....a free Christmas party each year and a dinner or luncheon from time to time.  What's all this extra money going toward?  Oh no...not another wasted batch of telephone poles for a development that never was!!!  Will we get that 1 month free again each year now that VEA has all this extra money?  Probably not, after all, the board members need
those payments of $650 per member, per meeting, monthly with some extra meetings thrown in as necessary, which they get paid per diem....(an allowance or payment made for each day)...( word...GREED...(intense and selfish desire for wealth)...they make $57.00 per hour now...plus benefits!!!!...that comes to over $200,000 a year (including benefits)...or will the new CEO get a ALL expenses paid)...I'm thinking of a raise from the present salary of $337,500 each year!!!  here in Pahrump!!!...oh...that includes benefits.  They invited us down for a meeting that started at 10 AM but they all paraded out from their own meeting which started at 9 AM, having already made their decision.  so that we could, all 60 + of us, WASTE OUR BREATH and that's exactly what we did because the VERY NEXT MORNING the papers reported an increase of even more than they stated to all 60 + of us who were at the meeting.  Let's show them that we will not sit down quietly, instead we will get up and fight for our rights...and this is one of them.  You may want to write a letter to the Editor or add something to ours, either way e-mail your letter so that you can be counted.  Think about it....once they see people take notice, it won't be as easy for them to get their ridiculous requests approved.  PPS...send this on to everyone you know that live in Pahrump...snow birds...you are affected as well.  Don't forget that very unfair change to get more $s out of YOU...print out a few copies and hand them out to your friends and family who don't have e-mail....strength in numbers!!!
