This window, on the side of the “Grill” was broken by the Burglars and used to enter the building and was also the exit. Andy Villanueva, Vincente Ornelas and Ernie Shilborof work at the Grill and supplied information about the robbery and break-in. Apparently during the night of Friday the 12th, a rock was thrown through the window, which was then used as the entrance by the burglars who removed the cash register containing $200. They then exited by the same window, with the register. Pete Hegge, Nye County Deputy Sheriff, had this to say about this incident: Charlie, I responded to the Ensenada Grill for a reported break-in that occurred during the night of 02/12/10. A  window was broken to gain entry and the cash register was taken. The crime scene was processed and latent evidence was taken from the scene to develop suspect information. This case is still under investigation. Pete Hegge

ARIEL MAE SIEDENTOPF SPICER

Ariel was the winner of the Beatty Lions Club Speakers Contest held on the 3rd of February 2010. She is a lifetime Beatty resident. Is 18 and a Senior. Ariel plays Volley ball basketball, softball and is on the National Honor Society Board. Included in her hobbies are; swimming and horseback riding. She plans on continuing her education in Utah and hopes (for now) to become a teacher. It was my honor to be one of the contest judges. It was also a pleasure to attend a meeting where the people knew their jobs and did them without bickering, or always trying to find ways to spend taxpayer money.

Ed. The following is partly my opinion and partly fact; you chose which. The County

has hired an (as you see her response to my request above) attorney to litigate the Janet Rogers suit. According to this Reno Attorney, (Rebecca Bruch), this allows the BTAB to hold secret meetings to discuss this case. They held such a meeting in the Sheriff Office already. When I asked for the minutes of this meeting, I was told, by Ms. Bruch, that the minutes are privileged. Now we have a serious problem; is everything that is covered in this secret meeting, privileged? What if they want to discuss community affairs? Is this privileged? Why do you and I have this stone wall to overcome?

This is what happens when you bring an attorney into the normal disagreements between individuals. Things just get more complicated. Here is it as I see it: When a meeting, by the BTAB, is held off campus (the comm.. center) it is privileged. Sounds, to me, like an excellent way to get around the open meeting laws. This is not over!

THE BTAB & ME

I got an email from Erika Gerling (BTAB treasurer) asking that I publish her comments about “The News” in this paper. Since her comments ran to book length, I have to pass. Erika also asked that I bring my comments to the Town Meeting and express them there. Does that sound like trying to suppress the news? It sure seems so to me. Sorry Erika; I will continue to inform the Citizens of Beatty in the open and honest method I have used in the past. (Ed. I have been told that I should be ethical in my reporting; except that reporting news does not require ethics.)

JANET ROGERS LETTER OF RESIGNATION dated February 12, 2010

Due to the Board actions at previous meetings regarding employee performance and/or affairs in open forum, I feel it appropriate to use this time to tender my resignation. My personal feelings of the Boards distrust toward a seasoned employee, coupled with the actual avenues of communication, I am making my last day of employment with Nye County, February 24, 2010. I would like to thank the Boards, both past and present and assure them, future opportunities will present themselves. Considering this is the public comment portion of tonight’s meeting: this is not open for discussion. Janet Rogers (Ed. On Friday the 12th, Nye County sent a representative to hand Janet her final check and escort her from the Beatty Town Office).

Mr. Cook:  I am the attorney who represents the BTAB.   It is my understanding that you have requested “meeting minutes” from a BTAB closed litigation session.   If you will review the Nevada open meeting laws, you will see that those closed litigation sessions are considered nonmeetings, and as such, are attorney-client privileged.    You are not entitled to access any minutes or any other information surrounding that nonmeeting.   If you have any questions about this issue, please contact me directly.     Thank you in advance for your anticipated courtesy and cooperation.
